1. Acceptance of these Terms

These Terms and Conditions govern access to and use of pricemal.com, including its pages, tools, information, content, comparison features, coupons, deals, guides and links to third-party websites.

By accessing or using Pricemal after these Terms have been made available, you acknowledge that you have read and understood them and agree to comply with them. If you do not agree with these Terms, you should stop using Pricemal.

These Terms should be read together with the Privacy and Cookie Policy and Disclaimer.

Nothing in these Terms removes, limits or waives a right or protection that cannot lawfully be excluded under applicable law.

2. Definitions

In these Terms:

“Pricemal”, “we”, “us” or “our” refers to the Pricemal website, service and responsible website operator.
“User”, “you” or “your” refers to any person accessing or using Pricemal.
“Merchant” means an independent retailer, seller, service provider or external website to which Pricemal may provide a link.

3. Nature of the Pricemal service

Pricemal is a price-comparison, coupon, deal, shopping-information and referral platform.

Pricemal may display product information, prices, availability, coupons, promotions, store and brand information, guides, comparisons and links to independent merchants.

Pricemal does not directly:

Sell the products displayed on the website.
Accept or process customer payments for merchant purchases.
Store or handle payment-card information for merchant transactions.
Deliver products.
Determine merchant stock or delivery availability.
Issue merchant warranties.
Approve merchant cancellations, returns or refunds.
Act as the seller, distributor, manufacturer or authorised representative of a listed product unless expressly stated.

The contract for any purchase is between the user and the selected merchant. The merchant’s own terms, privacy policy, payment, delivery, warranty, cancellation, return and refund rules apply to that transaction.

4. Eligibility

Pricemal is intended for people who are at least 18 years old or have reached the age of legal majority in their jurisdiction.

By submitting information, subscribing to communications or otherwise using interactive features, you confirm that you meet this requirement and that the information you provide is accurate.

If you use Pricemal on behalf of an organisation, you confirm that you have authority to act on its behalf and bind it to these Terms where applicable.

5. Product and merchant information

Product descriptions, specifications, model numbers, images, ratings, availability, warranty information and other listing details may be supplied by merchants, manufacturers, affiliate networks, distributors or other third-party sources.

Although Pricemal may take reasonable steps to review or organise this information, Pricemal does not independently manufacture, inspect, test or verify every product or listing.

Information may be incomplete, delayed, outdated, incorrectly matched or affected by technical or third-party errors.

Users must verify important product details with the merchant or manufacturer before completing a purchase, including:

Product model and version.
Colour, size, capacity and specifications.
Compatibility and included accessories.
Warranty terms and warranty provider.
Delivery location and expected delivery time.
Return, cancellation and refund eligibility.

6. Prices, savings and availability

Prices, displayed savings, reference prices, stock levels, taxes, fees, shipping charges and delivery information may be obtained from third-party sources and may change without notice.

A displayed price may differ because of location, account status, membership, payment method, delivery address, product variation, currency conversion, merchant fees, taxes or the time at which the merchant’s information was updated.

A displayed saving or discount may be calculated using a merchant-provided list price, previous price, reference price, promotional price or another available comparison value. It does not necessarily represent the lowest historical price or a saving available to every user.

Unless expressly stated otherwise, displayed prices may not include delivery charges, import charges, taxes or other transaction costs.

The merchant’s website at checkout is the final source for the applicable price, stock, taxes, fees, shipping, warranty and transaction conditions.

If information displayed by Pricemal differs from the merchant’s current information, the merchant’s information normally governs the transaction.

7. Coupons, deals and promotions

Coupons, vouchers, deals and promotional codes may be subject to conditions imposed by the relevant merchant or affiliate partner.

Conditions may include:

Expiry dates.
Minimum spending requirements.
Territory or delivery restrictions.
New-customer or selected-customer eligibility.
Product or brand exclusions.
Payment-method requirements.
Single-use or redemption limits.
Restrictions on combining promotions.
Account, membership or application requirements.

A merchant may amend, reject, suspend or withdraw an offer without notifying Pricemal.

Pricemal does not guarantee that every coupon, promotion or deal will remain available, apply to a particular order or be accepted by the merchant.

Users should review the merchant’s final price and promotional conditions before completing a transaction.

8. Affiliate relationships

Some links on Pricemal are affiliate or tracking links. Pricemal may receive a commission or another benefit when a user clicks a link, purchases a product or completes another qualifying action.

This generally does not increase the price paid by the user, although the final price and transaction terms remain controlled by the merchant.

Whether a referral is recorded, attributed or eligible for commission is determined by the relevant merchant or affiliate partner. Pricemal does not guarantee that every click or transaction will be tracked or generate commission.

The existence or absence of an affiliate relationship does not guarantee a product’s quality, suitability, availability or value.

9. Rankings, ordering and recommendations

Products, prices, stores, coupons, deals and content may be ordered or displayed using factors such as:

Relevance to the user’s search or selected category.
Price and availability.
Data completeness and quality.
Popularity and user interactions.
Recency.
Editorial selection.
Technical compatibility.
Affiliate tracking availability.
Commercial or sponsored arrangements.

Not every available merchant, product or offer is necessarily included.

The first-listed result is not guaranteed to be the cheapest, best, highest-quality or most suitable option for every user.

Sponsored, promoted or paid placements should be identified where applicable. Users should independently compare the relevant product details and final merchant terms before making a decision.

10. Merchant transactions

Merchants operate independently from Pricemal.

Pricemal is not a party to the transaction between a user and a merchant and does not control the merchant’s:

Payment processing.
Order acceptance or cancellation.
Stock allocation.
Delivery or collection.
Product quality or authenticity.
Customer service.
Warranty handling.
Returns or refunds.

Questions or complaints relating to a purchase must first be directed to the merchant that completed the transaction.

Pricemal may, at its discretion, help a user identify the relevant merchant or report inaccurate listing information, but this does not make Pricemal responsible for resolving the merchant dispute.

11. Third-party websites and services

Links on Pricemal may direct users to websites, applications or services operated independently by third parties.

Pricemal does not control and is not responsible for their content, security, availability, accessibility, privacy practices, cookies, payment systems or customer service.

A link does not necessarily mean that Pricemal endorses every product, statement, policy or practice of the external party.

Users should review the external website’s terms, privacy policy and transaction details before proceeding.

12. Editorial content and guides

Guides, articles, comparisons, summaries and recommendations are provided for general informational purposes.

They do not constitute financial, legal, medical, technical or other professional advice.

Content may reflect information available at the time it was prepared and may not immediately reflect later market, merchant or product changes.

Users should obtain appropriate professional advice where a decision requires it.

13. User communications and submissions

If you send a message, correction request, complaint, suggestion or other material to Pricemal, you confirm that:

The information is accurate to the best of your knowledge.
You have the right to provide it.
It does not unlawfully infringe another person’s rights.
It does not contain malware, unlawful material or deliberately misleading information.

15. Intellectual property

Pricemal’s original website design, text, databases, compilations, graphics, software, interfaces and branding are protected by applicable intellectual-property laws.

Third-party product names, logos, images and trademarks remain the property of their respective owners. Their appearance on Pricemal is for identification, comparison or informational purposes and does not by itself imply sponsorship, endorsement or partnership.

You may use Pricemal for personal and non-commercial purposes.

Reproduction, redistribution, republication, framing, modification, commercial exploitation or creation of a competing database from Pricemal content requires prior permission unless permitted by applicable law.

The website will always operate without interruption or error.
A product, merchant or offer will meet a user’s individual requirements.
Using Pricemal will produce a particular financial or commercial result.

Nothing in these Terms excludes a warranty, obligation or protection that cannot lawfully be excluded.

22. Limitation of liability

To the fullest extent permitted by applicable law, Pricemal is not responsible for indirect, incidental, special or consequential loss arising solely from:

Reliance on inaccurate, incomplete or outdated third-party information.
A merchant’s acts, omissions, products or services.
An unavailable, expired or rejected coupon or promotion.
A price or availability change.
An external website, application or payment system.
Loss of access caused by maintenance, technical faults, security incidents or circumstances beyond Pricemal’s reasonable control.
Unauthorised use of a user’s device or internet connection.

Pricemal does not exclude or limit liability where exclusion or limitation is prohibited by applicable law, including liability arising from fraud, wilful misconduct or another matter that cannot lawfully be excluded.

Users remain responsible for verifying material product and transaction information with the relevant merchant.

23. Consumer rights

Nothing in these Terms removes or limits mandatory consumer rights available under applicable law.

Where a provision conflicts with a mandatory consumer-protection requirement, the mandatory requirement will apply to the extent of the conflict.

Because the merchant is the seller in an external purchase, product, payment, delivery, warranty, cancellation, return and refund claims should normally be directed to that merchant.

24. Indemnity

To the extent permitted by applicable law, you agree to be responsible for claims, losses or reasonable costs arising from:

Your unlawful or fraudulent misuse of Pricemal.
Your deliberate interference with the website or its security.
Your infringement of another person’s intellectual-property, privacy or other rights.
Material submitted by you in violation of these Terms.
Your material breach of these Terms.

This section does not require a consumer to compensate Pricemal where doing so would be prohibited by applicable law.

25. Suspension and restriction

Pricemal may restrict, suspend or block access where reasonably necessary to:

Protect the website, users, merchants or third parties.
Investigate suspected fraud, abuse or security threats.
Prevent unlawful automated activity.
Enforce these Terms.
Comply with applicable law or a lawful authority request.

Pricemal is not required to provide advance notice where immediate action is reasonably necessary for security, fraud prevention or legal compliance.

26. Events outside reasonable control

Pricemal is not responsible for delay or failure caused by events outside its reasonable control, including internet or hosting failures, power outages, cyberattacks, telecommunications failures, government action, natural events, labour disputes or failures of external merchants and service providers.

27. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates.

Users are encouraged to contact Pricemal first so that a concern can be reviewed and an appropriate response provided.

Subject to mandatory consumer-protection and jurisdictional rules, disputes will be submitted to the court or authority having jurisdiction under applicable UAE law.

28. Changes to these Terms

Pricemal may update these Terms to reflect changes in its services, technology, legal requirements or operating practices.

The effective date, last-updated date and version number will be updated whenever revised Terms are published.

Material changes may be communicated through an appropriate website notice.

Continued use after the effective date of revised Terms constitutes acceptance of those Terms where permitted by applicable law.

29. Miscellaneous provisions

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

A delay or failure by Pricemal to enforce a provision does not waive the right to enforce it later.

Section headings are included for convenience and do not change the meaning of these Terms.

Pricemal may transfer its rights or obligations as part of a genuine restructuring, transfer or change in operation, subject to applicable law.

You may not transfer your rights or obligations under these Terms where doing so would adversely affect Pricemal or another person without permission.

These Terms, the Privacy and Cookie Policy, the Disclaimer and any additional terms presented for a particular feature form the agreement governing use of Pricemal.

If these Terms are translated, the English version will apply to the extent permitted by law if there is an inconsistency.
